1. GENERAL PROVISIONS

1.1 These general terms and conditions of sale (hereinafter, the "general terms and conditions") govern the sale of items from the My Style Home collections (hereinafter, the "products") marketed by Milano Confezioni S.r.l. with registered office at Via Vincenzo Monti 27, 20123 Milan, VAT registration number 13084280158 (hereinafter, "Milano Confezioni") through the dedicated area of the website www.mystylehome.it by following the procedures set out within the same.

1.2 For the purposes of these general conditions, final consumer (hereinafter, "customer") means any natural person, possessing capacity to act, over 18 years of age and who purchases goods for purposes unrelated to any entrepreneurial, commercial, handicraft or professional activity carried out.

1.3 Milano Confezioni can arrange not to process orders coming from subjects not definable as final consumers or in any case not corresponding to the provisions of its own commercial policies and in particular orders coming from subjects in law definable as companies.

1.5 These terms and conditions govern only the proposal, submission and acceptance of purchase of products through www.mystylehome.it.

2. CONCLUSION OF THE CONTRACT

2.1 The contract is concluded in Italy between the customer and Milano Confezioni S.r.l.

2.2 Before proceeding to purchase, the customer must carefully read the general conditions of sale made available on the website www.mystylehome.it

2.3 To formulate an order, the customer must complete and transmit to Milano Confezioni the appropriate order form. The proposal to purchase products is formulated by the customer when sending the order form in electronic format.

2.4 Once the order form is sent, a summary page of the order is displayed with the characteristics of the product ordered.

2.5 The contract is considered concluded when, following the payment made by the customer, Milano Confezioni receives and accepts the complete and correct order form.

2.6 The order form is kept the time necessary to carry out the order processing.

2.7 The customer will receive an invoice by filling in the appropriate fields indicated in the billing address. The invoice will be sent by email following the fulfillment of the order.

2.8 The languages provided for the conclusion of the contract are Italian and English.

3. GUARANTEE OF AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS

3.1 Milano Confezioni guarantees the authenticity of all products purchased on www.mystylehome.it.

3.2 The trademark "My Style Home", as well as all figurative and non-figurative trademarks, service marks, present on the products, their accessories and/or packaging, shape marks, whether registered or not, as well as all illustrations, images and logos protected by copyright, and, more generally, all intellectual property rights relating to the products are and remain the exclusive property of Milano Confezioni S.r.l.

4.INVALID ORDER PROPOSAL

4.1 All orders are subject to acceptance by Milano Confezioni S.r.l., which reserves, at its sole discretion, the right not to process any order proposal in the event that:

 - The data provided by the customer when filling out the order form is incomplete or incorrect;

- The customer does not qualify as an end-consumer or does not meet the requirements to give effect to the terms of payment according to the corporate policy of Milano Confezioni;

- The products ordered are not available. To this end, Milano Confezioni will not be held responsible for changes in the availability of certain products. If only part of the products ordered are not available and there are no other causes that may legitimize the non-acceptance of the order proposal, Milano Confezioni will follow up the order proposal limited to the products available.

5. PRICES

5.1 The sale prices of the products are expressed in Euro but do not include shipping costs, which will be added to the total amount due. 

5.2 Milano Confezioni reserves the right to change the prices shown on the site at any time. Under no circumstances shall Milano Confezioni be held responsible for any price changes.

5.3 The prices indicated in the Italian language version of the site are considered valid only for purchases made within the Italian territory. The prices indicated in the English language version of the site are considered valid for purchases made on territories other than Italian territory.

6. METHOD OF PAYMENT

6.1 The customer agrees to pay the price of products purchased with payment made through the secure servers of PayPal and in particular to pay either by credit card, if the 'user does not have a Paypal account, or through Paypal account if the user already has its own Paypal account.

6.2 The credit cards allowed by Paypal are: Visa, Maestro, Aura Card, Discover, Master Card, American Express.

6.3 Credit card payments are handled directly by PayPal's secure servers, which through the use of protocols with SSL 128 bit encryption, verisign certificate, guarantees the security of online transactions. For this reason, Milano Confezioni is not aware of the customer's credit card information, with total respect for the customer's privacy.

6.4 Once the order has been received Milano Confezioni will make through Paypal's secure servers, a pre-authorization request on the customer's credit card to ensure that the customer has sufficient funds to complete the transaction.

6.5 Credit cards will be subject to verification and authorization by the credit card issuer. Milano Confezioni will not be responsible for any failure to obtain authorization from that entity. Once the contract has been concluded pursuant to Article 2.5 above, the credit card charge will be final.

6.6 For users who are already registered on Paypal and have an account, payment can be made directly through their Paypal account.

6.7 By making a purchase on the website www.mystylehome.it you accept the policies regarding the storage/use of personal data and the use of Cookies; with reference to the confidential data required for payments made by credit card (card number, cardholder, expiration date, security codes) it is emphasized that the same will be acquired by the provider of payment services (Banca BPN) which will act as an independent data controller, without passing through the server of Milano Confezioni S. r.l. . The data will be acquired in encrypted format in application of the security requirements of PCI certification and processed via TLS ( Transport Layer Security) protocol.

7. MODE OF SHIPMENT OF PRODUCTS

7.1 The products will be delivered on the basis of the times and in the manner reported in the delivery service chosen by the customer and reported in the order placed on the site, about 1/2 working days Italian territory and 3/4 working days rest of the world.

7.2 Transportation costs are borne by the customer and may vary depending on the country of delivery chosen: the service will be carried out by the company DHL. Shipping costs will be calculated for each order, according to the country of destination of the ordered product(s) and according to the weight of the shipped package.  

7.3 The customer will be able to check the delivery status through the tracking code that will be emailed by the courier company.

7.4 Product shipments are made only in certain countries, that is, in the countries indicated during check out and selectable in the delivery address mask."

7.5 Milano Confezioni is not responsible for delays or non-delivery of products by the courier. From the moment the courier picks up the products ordered by the customers, all responsibility regarding the delivery of such products lies solely with the courier. Milano Confezioni is not responsible for loss, theft or damage that occurred during shipment.

7.6 The customer agrees that if delivery is made abroad, customs charges and import taxes will be borne by the customer and that as an importer, the customer must comply with the import law of the relevant country.

8. RIGHT OF WITHDRAWAL

8.1 The customer has the right to withdraw without penalty and without specifying the reason, within the term of 14 days from the day of receipt of the products purchased under these general conditions. 

8.2 The withdrawal must be exercised within the period referred to in the preceding paragraph by returning the purchased products, after the necessary activation of the return procedure by contacting Milano Confezioni through the email address

8.3 It is an essential condition for the exercise of withdrawal by the customer that the integrity of the products to be returned is preserved. In particular, the products must not have been used, worn, washed or damaged; the identification tag must still be attached to the products with the disposable seal, as well as the internal labels of brand, composition and washing must not have been removed or sewn up in any way.

8.4 In accordance with the provisions of Article 55(2)(d) of the Consumer Code, the right of withdrawal, cancellation or return, which would otherwise be available, is excluded in the case of orders for customized products. In particular, customization is achieved through embroidery or embroidery expressly requested by the customer at the time of purchase.

8.5 The cost of returning the product shall be borne by the customer.

9. REFUNDS

9.1 If the right of withdrawal is exercised correctly, that is, according to what is specifically indicated in art. 8 above, Milano Confezioni S.r.l. will make a refund of the amount in the same manner in which the customer made the payment, no later than 30 days from the date on which he became aware of the right of withdrawal, subject to the actual return of the products.

9.2 Otherwise, Milano Confezioni will not refund the amount requested by the customer.

10. APPLICABLE LAW AND COMPETENT COURT

10.1 The general conditions of sale are governed by Italian law and in particular by Legislative Decree No. 206 of September 6, 2005, on the Consumer Code in Chapter I° "Of Consumers' Rights in Contracts", with specific reference to the regulations on distance contracts and by Legislative Decree No. 70 of April 9, 2003 on certain aspects concerning electronic commerce.

10.2 Except in the event that the applicable legislation provides for a different exclusive jurisdiction, all disputes however arising from the interpretation or execution of the general conditions of sale and contracts entered into in observance thereof, are referred to the exclusive jurisdiction of the Court of Milan, expressly renouncing the parties to any other competing and/or alternative jurisdiction.

11. MODIFICATION OF THE GENERAL CONDITIONS

11.1 The following general conditions may be subject to change over time and the new provisions will become effective from the date of publication on the website www.mystylehome.it.

12.1 By making a purchase on www.mystylehome.it you agree to the policies regarding the storage/use of personal data and the use of Cookies.

13. CUSTOMIZATION

13.1 The embroidery that appears in the customization screen of each Product, is merely indicative, and may differ in position, color, from the actual customization of the product/products purchased: each embroidery is handcrafted.
